House of Franc welcomes you to houseoffranc.com. We would like you to have the best possible experience with us. By using this website you agree to be bound by the Terms and Conditions set out below. If you do not agree to these Terms and Conditions in their entirety you must immediately stop using this website.
House of Franc website is provided solely for your personal use. You may not use this website for any commercial purpose.
References in these Terms and Conditions to “we”, “us” and “House of Franc” are to House of Franc, which is a trading name of Weddings by Franc Limited, a company incorporated in Ireland with company number 369474 with a registered Office at Woodview House, Duntaheen Road, Fermoy, Co Cork, P61 V028 Ireland.
We will take all reasonable care to ensure that all details, prices, photographic representations and descriptions of products appearing on the website are correct at the time when the relevant information was entered onto the system. We have made every effort to display as accurately as possible the appearances, colours, textures or finishes of our products that appear on the website. What you see will depend on your monitor and computer equipment, we are therefore unable to guarantee that the product images are an accurate representation of the actual merchandise. Please refer to our Returns Policy if you are unhappy with your purchase. We will not be liable for any reason if the House of Franc website is unavailable at any time or for any period. From time to time, we may restrict access to some parts of or the entire House of Franc website.
All orders that you place on this website will be subject to acceptance in accordance with these Terms and Conditions.
Non-acceptance of your order may be due to any one or more of the following non-exhaustive reasons:
-The product you ordered is out of stock;
-Our inability to obtain authorisation for your payment;
-We have identified a pricing or product description error;
-There is a system or procurement failure; and Failed customer validation checks.
When you place an order on our website we will email you an acknowledgement detailing the product you have ordered. This email is not an order confirmation or order acceptance from House of Franc. Acceptance of your order and the completion of the contract between you and House of Franc will take place when your order has been dispatched. We will email you when your order has been dispatched. We reserve the right to dispatch multiple orders separately.
Delivery / Collection
Standard delivery services are provided by courier Monday – Friday. Standard delivery to most addresses in Ireland generally takes up to 2-3 working days and requires a signature. All items can be tracked online.
Please note that your delivery may take longer during sale or other busy periods. We are unable to guarantee delivery earlier than this time frame.
We will make every effort to deliver goods within the estimated timescales. However, delays are also occasionally inevitable due to unforeseen factors or events outside our control, for example extreme weather, a flood or fire. House of Franc shall be under no liability for any delay or failure to deliver the products within estimated timescales.
Title and risk in goods pass to you on delivery or collection, as the case may be and is acknowledged by a valid signature of persons 18 years or over.
We will notify you of the delivery cost at the time we acknowledge your order. For bespoke or special delivery items a separate communication of delivery cost may be made.
We currently deliver to the island of Ireland only, but we will accept orders from customers living outside of Ireland. Delivery will be separately calculated per order basis.

Collection of your order is also possible from our warehouse in Ballyleggan, Glanworth, Co. Cork P51T326 during weekday opening hours, 9am – 5.30pm
Each product is sold subject to its individual product description which may set out additional specific terms and conditions related to that product including without limitation terms and conditions concerning estimated delivery times. House of Franc does not accept responsibility for inaccurate content and/or safety instructions, which are included on any products supplied.
The material displayed is provided by way of information only, except in relation to the description of goods available to purchase online. Used and “Pre-Loved” props are of merchantable quality but may have historical wear and tear on the product or packaging, and on occasion, no original packaging.
The information and materials contained in this website are provided without warranties of any kind, either express or implied, and liability is excluded to the fullest extent permissible under Irish Law.
We feature products that have been carefully selected for sale on the House of Franc website. Once an item is sold out it will be taken off the website at the earliest opportunity and may not be available again. Prices of products may change from time to time. Goods are subject to availability. As there is a delay between the time when your order is placed, and the time when the order is accepted, the stock position relating to particular items may change. If an item you have ordered becomes out of stock before we accept the order we shall notify you as soon as possible and you will not be charged for the out of stock items.

It is our policy to try to process orders immediately; however, it may not always be possible to stop an order from being dispatched. After dispatch, our Returns Policy will apply.
All prices are inclusive of VAT (where applicable) at the rate appropriate and correct at the time of entering the information on to the system. Prices may change and offers may be withdrawn at any time.
Payment and Credit Card Fraud
To the fullest extent permitted by law, House of Franc and its related entities will not be responsible for any damages or consequential losses of any kind (whether direct or indirect) suffered by a user where a credit/debit card, PayPal account or other payment method is fraudulently used or is used in an unauthorised or improper manner.
Damaged or Faulty Goods
If any goods ordered by you arrives damaged or is not of acceptable quality you may have:
– rights under our returns policy
– legal rights and remedies in Ireland under the Sale of Goods and Supply of services Act 1980 or any other applicable legislation.
– the goods repaired or replaced or to receive a refund of the price paid by you for the goods.

Returns and Refunds
House of Franc will generally not provide you with a refund or exchange simply because you changed your mind or the goods were not what you expected.
If you have bought an item(s) online at houseoffranc.com and would like to return it, you have the right to cancel your order and return the goods, anytime before and up to fourteen (14) business days starting from the day after the goods are received by you, provided the goods are in resaleable condition and the packaging remains in an ‘as new’ state.
You will be responsible for the cost of returning the goods to us via An Post or Courier.
Alternatively, You can return your item(s) in person to our warehouse in Ballyleggan, Glanworth, Co.Cork, P51 T326 Ireland with your actual ‘Receipt’ and ‘Credit/Debit Card’ used. You must have these items for a refund.
A full refund of the value of the goods will be made upon our receipt of the returned goods.
Replacement products will be charged (including delivery) until the returned product has been received in a re-saleable condition.
You will only be refunded your delivery cost if the return is as a result of our error (e.g. faulty product or incorrectly shipped). If you paid by PayPal, in this instance please contact our Online Store first so we can organise the return/refund.
We will consider the condition of the goods being returned before deciding whether to make a refund. If we agree to provide you with a refund we will instruct our Merchant Acquirer to credit your credit card account within 30 days of receipt of the returned product. Your statutory rights are not affected.
Please note: If you are returning a faulty item with a receipt, then you may be entitled to a repair. If it can’t be repaired you may be offered a replacement and if it can’t be replaced you may be offered a refund. With the nature of any faults, each case will be dealt with on an individual basis.
Where promotional discounts are applied to orders, in the event of a return, you will not be refunded the discounted proportion. Additionally any complimentary promotional gift given with an order must also be returned if you are returning those goods to which the gift related.
You agree that any information provided by you will be true, accurate, current and complete; to abide by all applicable local, state, national and international laws and regulations ;that you are solely responsible for all acts or omissions that occur under your usage, including the content of your transmissions through the website ; that all information, designs, drawings and other specifications provided on the website are the exclusive property of House of Franc ; that any copying, transmission or re-transmission of the same requires the prior written approval of House of Franc ; and confirm that you are the authorised holder of any credit/debit card you may use on the Site; to notify us immediately of any changes to any information you have submitted to the Site; and to be available for delivery and to take delivery of any products ordered by you from the Site.
You may use our site only for lawful purposes. You may not use our site in any way that breaches any applicable local, national or international law or regulation; in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect; for the purpose of harming or attempting to harm minors in any way; to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam); or to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or computer code designed to adversely affect the operation of any computer software or hardware.
You also agree not to access without authority, interfere with, damage or disrupt: any part of our site; any equipment or network on which our site is stored; any software used in the provision of our site; or any equipment or network or software owned or used by any third party. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack.
In breaching this provision, you would commit a criminal offence (for example in Ireland under the Criminal Damage Act 1991 and/or under the Criminal Justice (Theft and Fraud Offences) Act 2001). We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately. We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any material posted on it or on any website linked to it.

You agree to indemnify us and our agents and officers, directors and employees, immediately on demand, against all claims, liability, damages, costs and expenses, including legal fees, arising out of any breach of these Terms and Conditions by you.
We may terminate your use of the website immediately if we consider that you have breached these Terms and Conditions.
The website is controlled and operated in Ireland. Any terms and conditions concerning the usage of this website will be governed by the laws of Ireland and any dispute concerning use of this website will be determined exclusively by the Irish Courts.
Transfer and Assignment
If House of Franc merges, sells or otherwise changes control of its business or this website to a third-party, House of Franc reserves the right, without giving notice or seeking consent, to transfer or assign the personal information, content and rights that House of Franc has collected from you and any agreements it has made with you.
Immediate, temporary or permanent withdrawal of your right to use our site; Issue of a warning to you; Legal proceedings against you for payment for goods (if applicable), payment of monetary compensation and/or reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach; Further legal action against you; and Disclosure of such information to law enforcement authorities as we reasonably feel is necessary.

These Terms and Conditions constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and House of Franc. Any waiver of any provision of the Terms and Conditions will only be effective if in writing and signed by a Director of House of Franc.
House of Franc will not be liable for any delay in performing any of their obligations if such delay is caused by circumstances beyond their reasonable control, including but not limited to, failure of or interruption in the provision of essential services such as electricity supply, bank payment systems or postal deliveries.
